Arrest Of One Of the Highland Lynchers Of Atchison (1884)

This is what the Staunton Spectator, Staunton, Virginia, dated 26 February 1884, Tuesday, page 3, reported: "Arrest of One of the Highland Lynchers of Atchison."

We learn from the Highland Recorder that, on Sunday night of last week, deputy Sheriff E. M. Arbogast and O. A. Bird arrested at his home on Back Creek and took to Monterey John A. Chestnut, one of the men charged with the lynching of Atchison on the morning of January 5, 1884.

On Monday morning Chestnut was brought before Squire O. Wilson, who committed him to jail to await a preliminary nearing on Wednesday.

A number of witnesses were summoned for the prosecution and defense, and on the day named the parties met at the courthouse, Justice Wilson presiding.

Judge Myers appeared for the defense, and stated that M. F. White, Esq., of Staunton, was associated in the case, and therefore asked that the examination be postponed until he could be sent for.

Commonwealth's Attorney Stephenson said the witnesses were all present and he insisted that the examination proceed. Mr. Wilson so decided, and thereupon Judge Myers waived examination.

The witnesses were recognized i the sum of $1,000 each to appear on the first day of next county court. The prisoner was sent to jail.

Meade F. White, and James Bumgarner, Esqs., of Staunton, J. W. Stephenson, Esq., of Warm Springs, and Judge Myers, of this place, had been retained for the defense in the several cases growing out of the lynching tragedy.
