It concerned a possibility of the actual trial of the Jess Taylor murder case starting late that afternoon, the entire morning having been spent int he examination of jurors for duty, with a call for a special entire of 30 issued by the court to report at 2 o'clock.
At noon, the available jurors, 20 in number, had been exhausted. At that hour there were 11 men in the jury box, with none accepted, with nine excused for cause and with only on peremptory challenge by the state having been exercised. The men in the jury box were given into the custody of the bailiff for dinner with the usual instructions not to talk with one another concerning the case or to permit others to converse with them.
The defendant was charged with he murder of Gus Lamneck, whose death occurred following an altercation between the deceased and Taylor some months ago. At the preliminary hearing Taylor was held subject to the action of the district court. He was released on bond shortly after the preliminary hearing.
A blow on the head was said to have caused the death of the defendant, and the struggle in which the blow was alleged to have been delivered by Taylor occurred, it was claimed, as a culmination of a misunderstanding or petty quarrel, existing for some time between the two.
