(Alva's First Homicide - 9 November 1910)

Mr. L. T. Wilson of counsel for the defendant read to the jury the deposition of James Roller as attached to the defendant's motion for continuance, which said deposition is in words and figures as follows. This was after C. H. Mauntel testified for the defense.

James Roller Deposition...

My name is James Roller, and my post office address is Skiatook, Oklahoma, and that in the month of November, A.D. 1910, I was residing in Woods County, Oklahoma, and that I was acquainted with N. L. Miller, the defendant in this action and that on the 9th day of November, A.D. 1910, I was in the city of Alva, Woods County, Oklahoma, I saw the defendant, N. L. Miller, on the afternoon of November 9, 1910 from about 12:45 P.M. to 1:45 P.M. of that day, and I saw him continuously during the hour from 12:45 p.m. to 1:45 p.m., and at said time we were in front of Jesse Jackson's Cigar Store on the west side of the public square in the city of Alva, Oklahoma, learning the election returns of the election held on the day previous. At the time I first saw N. L. Miller he drove up in front of the cigar stand in his buggy, drawn by his gray mare, alighted from the buggy and left the mare unhitched in the street. Miller was not away from the front of Jesse Jackson's cigar store or from near the front thereof during all of the hour here in before stated.
