Change of Venue

Woods County files - Case #612...

The Woods County, Case #612, Murder Trial of N. L. Miller continues as the filings get filed and witnesses get added to the list of characters. 

The Prosecuting attorneys... Claud McCrory, Sandor J. Vigg, Moman Pruiett, T. J. Tincher. 

The Defense attorneys... Snoddy, Wilson and Grove. Chris H. Mauntel left as defense attorney when the case was transferred to Woodward County, Oklahoma.

The docket sheet begins Jan. 6, 1911, with the filing of information, oath, certificate and seal. 

County Attorney Claud McCrory steps down and resigns and county attorney, 9 January 1911. Sandor J. Vigg took over as County Attorney. 

27 January 1911 -- The case was entered on Bar Docket.

6 February 1911 -- Served all of the within named witnesses personally, except C. O. Green& Hugh Martin by leaving copy at residence.

9February 1911 - Additional witnesses and list of Witnesses in Chief were filed. 

27February 1911 -- an affidavit of N. L. Miller was filed and entered as well as for a Change of Venue. 

Other affidavits filed and entered for E. P. Weaver, Geo. S. Parker, J. D. Scott, J. H. Gilmore, E. D. Drake, J. P. Renfrew, Harry E. Mason, J. G. Bittner, D. C. Green, Benj. Dunning, J. M Free, J. F. Bolte, L. W. Bevis, John Luse, C. J. Funk, J. W. McWilliams, M. T. Wilson, W. W. Hiatt.

28February 1911 -- Enter arraignment of Defendant and an Order giving defendant one day to plead.

29 February 1911 -- Order overruling defendants Demurrer to Information. There were also witnesses for the State added to the list: H. F. Ketchen, S. B. Share, Geo. Bell, Ray Close, Geo. Dexter, Claud McCrory.

Finally...Through all the filing, orders, demurrers -- The sheriff delivered the body of Nelson L. Miller to the sheriff of Woodward County on September 4, 1911.

News Articles Gives Updates...

Alva Review Courier, dated 9 Feb. 1911, "At Court House" -- "Court convened in earnest this morning and parties charged with felonies were arraigned and given one day to plead." - In the case of State vs. N. L. Miller, defendant arraigned and given one day to plead. 

March 2, 1911, "Miller Granted Change" Alva Review Courier -- "N. L. Miller, charged with the murder of Mabel Oakes, will be tried in Woodward in June. Judge Loofbourrow granted a change of venue today." 

March 3, 1911, Renfrew's Record, District Court Notes -- "N. L. Miller, charged with the murder of Mabel Oakes, was granted a change of venue by Judge Loofbourrow Monday. The case was set for trial in the Woodward District Court next June. The state's attorneys concede that Judge Loofbourrow did right in granting the change of venue."

June 30, 1911, Renfrew's Record, Trial of N. L. Miller - Case Postponed -- The trial of N. L. Miller, charged with the murder of Mabel Oakes, which was set for trial at Woodward, July 10th, has been postponed till the Fall term.

It was also about this time that Nelson L. Miller was transferred from the Woods County jail to the Woodward jail. According to Renfrew's Record, dated 30 June 1911. 

The article goes onto to state, "The County Attorney Vigg decided that this was the proper course to take, as change of venue had been taken to Woodward County and District Court convened, July 3rd, 1911.The case has been set for July 10, but as no jury has been called for this term, there is no probability that the case will be tried before the fall term."
